Terms of Service
Please read the ToS carefully before commissioning me, as they contain a lot of relevant information and may answer some questions you may have.
Pricing
The prices listed on my commission sheets are base prices. Depending on the complexity of the design you wish me to draw, a surcharge may be applicable to compensate for the extra time it takes me to finish your commission. I will, however, always inform you of the total price before sending you an invoice.
Payment
Payments can only be accepted via Paypal, in Euros (please don’t send me a different currency!). You will receive an invoice from me once your commission has been chosen; please do not send me any money before then, or through any other services!
You may choose to pay in full straight away, or half upfront and half upon completion. If I have sent you an invoice but not received payment within 7 days, your commission will be canceled and I will move on to the next person in the queue.
Please note that I can only send you the high res files after the commission has been paid in full!
Refunds
There are certain cases in which a refund (full or partial, upon request) is possible:
- I can grant a full refund within 48 hours of payment being made if I haven’t started work on your commission.
- I can grant a partial refund if more than 48 hours have passed since payment being made, and/or if I have started work on your commission.
- If more than 60 days have passed and no progress has been made on your commission, I can grant a partial refund. This will, however, also mean that I will cease work on your commission.
- If I’m unable to start/complete your commission for any reason, I will grant you a full refund if work hasn’t started, or a partial refund if it has.Please also be aware that a chargeback via Paypal will forfeit your right to receive any content created by me! If there’s an issue with your commission, please contact me instead.
References
It is your responsibility as the Client to provide me with visual references of the character you want me to draw. These references can include previous commissions, sketches, mood boards, even stick figures! Please also note any features that may be hard to spot on these references (for instance, small scars or jewelry)!
If you can’t provide any visual references of your character, I retain the right to charge a character design fee, which depends on a number of factors, but ranges between 25% and 50% of the total commission price.
If you have written references, please make sure to send them in a concise manner, such as clearly structured bullet points. Do not send me walls of text!
Revisions
You will be sent a sketch for approval before I continue working on the commission. During this stage, you’re entitled to one major revision, which typically includes changes to pose, clothing, props, hair, or facial expression. Once you’ve approved the commission, I will begin refining the artwork, after which a major revision will be subject to a fee.
Minor color changes or other small details are usually able to be made throughout the commission process, within reason. If you notice any small mistakes after initially approving the sketch, please let me know asap! I’ll be happy to correct these mistakes for free.
Changes can, however, no longer be requested after 7 days of you receiving the finished commission.
Use
All commissions are for personal use only, unless we have worked out a licensing agreement. I, as the Artist, therefore retain all rights to the finished work and any artwork created during the process of completing your commission.As the copyright holder, I’m permitted to:
- display the artwork online wherever I choose (that’s usually my social media and portfolios, but can include other places as well), unless we’ve made arrangements to keep the commission private.
- sell content featuring the artwork, with your permission.
- include the artwork in collections alongside other commissions for advertising purposes.
- recycle/reuse any sketches that were rejected by you, the Client, be it for either commissions or personal work.You, as the Client, are permitted to:
- share low res versions of your commission Twitter, Facebook, Tumblr, and Instagram, including as icons/avatars, giving credit by either tagging me or providing a link to my socials. Please do not share them anywhere else without asking me!
- use the artwork for personal items (for instance, as a wallpaper, poster, phone case…).You, as the Client, are not permitted to:
- sell the artwork in any shape or form, whether digitally or physically. This includes art prints, merchandise, books, etc. It especially includes NFTs.
- use the artwork to promote/advertise anything that will make you money.
- make alterations/edits to the artwork (cropping and adding text is fine).
- remove my signature/watermark from the artwork.
- feed the artwork to any image generating AI, such as Stable Diffusion, Midjourney, or Dall-E.
- share the artwork anywhere other than the social media listed above without asking me first; this is because there are some sites out there that masquerade as art sharing services but secretly harvest the art for AI or NFT purposes.Please be aware that you’re purchasing my labor, not the rights to the artwork! If you want to use the commission for commercial purposes, we can work out a licensing agreement, which you can obtain at any time during or after the commission process. This licensing fee depends on a number of factors, like time frame, distribution, and profits.
You, as the Client, retain all rights to your respective character(s).
Licensing and Transfer of Copyright
If you would like to use the artwork commercially, you may buy an additional license. These licenses are individual, but you may inquire about a quote at any time during or after the commission process.
A full transfer of copyright, while possible, is the more expensive option. In most cases, a license will suffice.
Please also note that if you feed the artwork into a machine learning algorithm, I will consider this a full transfer of copyright, and you will be billed accordingly.
